PERSONAL HEALTH STATEMENT

Your health is your responsibility. The management and staff of Underground Gym are dedicated to helping you make the most of the facilities we offer. To ensure a safe and enjoyable experience, we have carefully considered our mutual expectations.

OUR COMMITMENT TO YOU

- We will respect your personal decisions and allow you to decide what exercise is appropriate for you. However, we ask that you do not exercise beyond your abilities.

- We will make every reasonable effort to ensure that our equipment and facilities are safe for you to use and enjoy.

-  We will ensure that our staff are qualified according to fitness industry standards, including those set out by the Chartered Institute for the Management of Sport and Physical Activity (CIMSPA).

- If you inform us of a disability that puts you at a disadvantage in accessing our equipment and facilities, we will consider and implement reasonable adjustments.

YOUR COMMITMENT TO US

- You should not exercise beyond your own abilities. If you have or suspect a medical condition that may affect your ability to exercise safely, you should seek advice from a medical professional before using our facilities.

- You should familiarize yourself with the rules and instructions, including any warning notices. Exercise carries inherent risks, and you should avoid activities deemed unsuitable for you.

- You should immediately notify us if you feel unwell while using our facilities. While our staff are not qualified doctors, a trained first aider will be available.

- If you have a disability, you must follow any reasonable instructions to allow you to exercise safely.If you have a disability, you must follow any reasonable instructions to ensure your safety while exercising.

- This statement is for guidance only and is not a legally binding agreement between you and us, nor does it create any obligations that either party must meet.

1. DEFINITIONS:

- The Club: Underground Gym locations at Portslade, Newhaven, and Tunbridge Wells.

- The Club Rules:  The rules and regulations of the Club, as amended from time to time. A copy will be provided with your membership application and further copies are available on request.

- Commitment Period: The minimum term you agree to remain a member of the Club, starting from your commencement date, is 30 days (subject to extension if your membership is suspended).

Membership:

- By signing up online, you agree to comply with these Terms and Conditions and the Club Rules.

- You will only be permitted to use the Club facilities if your membership is current and fully paid, or if you have made payment arrangements acceptable to the Club.

- Confirmation of Agreement: By using the gym after joining, you accept the terms and conditions and parameters of the agreement, a copy of which is provided upon joining.

Duration:

For memberships paid annually in advance or monthly by direct debit, you are entitled to renew your membership under the same payment options upon expiration. Monthly payments beyond the initial membership period will constitute renewal for a further period at the prevailing rate according to these Terms and Conditions.

Fees:

The Club sets and periodically reviews fees, reserving the right to change them with at least 30 days' written notice. Fees will not increase during your Commitment Period.

The following fees prevail:

- Membership Fee: Determined by the type and category of membership.

- Joining Fee: Payable as specified in your application form and used for startup costs.

- Other Fees: Include charges for additional services such as physio, sunbeds, protein, nutrition, food, and beverages, and are payable in addition to membership fees.

- Failed Payments: If your bank fails to make a direct debit payment, we may reapply for payment and charge a fee for any failed attempts or letters sent regarding unpaid amounts. Unpaid fees after 30 days may be referred to a debt collection agency, incurring additional charges.

- Any unpaid and overdue membership fees referred to a debt collection agency will be subject to a surcharge of no more than £30 to cover the collection costs incurred. This surcharge, together with all other charges and legal fees incurred in the collection of the overdue membership fees, will be the responsibility of the member and will be legally recoverable from the member.

- The Club is entitled to collect an annual enhancement fee of £19 for facility improvements.


Member Rewards Scheme:

The Club may offer rewards for introducing new members. Benefits are applied only if both your membership and the referred member’s membership are current and not suspended. The reward may be adjusted if the referred member changes their membership type.

Freezing of membership:

Membership may be frozen for illness or injury for a period of 1 to 3 months, with 30 days' written notice. A doctor’s certificate may be required. Freezing extends the Commitment Period by the length of the freeze.

Termination:

Termination by the Club
We may terminate this agreement for serious or repeated breaches, non-payment of fees, or provision of false information during membership application. We reserve the right to retain a portion of payments to cover reasonable costs.

- Termination by you
You may terminate this agreement in the following circumstances:

- You may terminate during the Commitment Period, but your membership will not end before the period’s conclusion. After the Commitment Period, you may terminate with 1 full calendar month’s notice.

- Direct debit cancellations are not sufficient; notice must be provided in writing.

- Cancelling your direct debit instruction for the payment of fees is not sufficient.

- Membership may also be terminated with 1 month's notice due to serious illness or injury precluding gym use for at least 6 months (evidence required), or if the Club permanently reduces facilities, changes location, or closes for over 30 days for refurbishment.

-You may also terminate this agreement if:

- We permanently reduce the facilities or opening hours of the Club

- We change the location of the Club; or

- We close the Club for refurbishment for a period of more than 30 days at a time

- A member requires confirmation in writing of cancellation from the Club Manager and they should contact the Club Manager if this is not received with in 7 days of the member giving notice to cancel. The member should provide details of the address for delivery of this written notice if this address is different from that held by the Club Manager.

Access Control:

Upon joining, you will receive a virtual membership QR code via the Underground Gym app. The QR code is non-transferable; misuse may result in membership termination.

Club Rules:

The Club may amend rules for health and safety reasons, with temporary amendments displayed in the Club and permanent changes communicated with at least 30 days' notice.

Restriction of Liability:

The Club is not liable for loss, damage, or theft of personal property stored in lockers, except where caused by our negligence or that of our staff. Liability for non-personal injury is limited to a reasonable amount considering factors such as negligence.

Health & Safety:

Members must read and comply with all Health and Safety notices displayed in the Club.

Sale of Club:

In the event of a sale or transfer of the Club, your membership will be transferred to the new owner, with no adverse effect on your contractual or statutory rights.

Notices:

Notices to the Club must be in writing and addressed to the general manager. Notices from the Club will be emailed or posted to your recorded address.

Induction:

All members must undergo an induction to learn how to use the equipment safely. Please arrange your induction with the Club.

Club Enhancements:

The Club may collect an annual enhancement fee of £19 for facility improvements, as agreed upon during membership sign-up.

Membership Subscription:

Monthly memberships are collected via Direct Debit by a third-party operator on behalf of Underground Gym. 30 days' notice is required for cancellations or changes, which must be communicated via email or in writing.

Email Updates:

In compliance with UK GDPR, we may use your contact information for internal marketing, newsletters, and membership updates. You may opt out by contacting Underground Gym.

Parking:

Register your car at reception on your first visit. Failure to do so may result in a parking ticket. Parking is limited to 3 hours per visit. Non-compliance may result in loss of parking privileges.
